A minors estate


Q. My eight year old daughter passed away. She had a substantial amount of assets given to her on her name. Does the parents own her assets after her demise?

A. Upon the demise of a person, including any minors, his/her assets form part of their estate. The parents cannot take full possession of the minor’s assets without following an estate distribution according to Shariah. The normal distribution process of estates according to Shariah will be applicable to minor irrespective if he/she has a small amount or a substantial amount of assets.
