Does a penalty (Damm) apply to a woman in menses (Haidh) who has delayed the performance of Tawaaf-e-Widaa (farewell Tawaaf) after the days of Hajj?


Q. What is the ruling of performing Tawaaf-e-Widaa for a South African woman in menses? Does she have to perform it during the days of Hajj? If she delays it after performing Tawaaf-e-Ziyaarah and after the days of Hajj and then she has her menses, will there be a penalty for delaying it and not performing it on time?

A. The performance of Tawaaf-e-Widaa (farewell Tawaaf) is compulsory (Waajib) upon males and females performing Hajj except for a female who is in the state of menstruation (Haidh). The time to perform Tawaaf-e-Widaa is after the performance of Tawaaf-e-Ziyaarah until the time of one’s departure.

Hence, in the enquired case, if a woman did not immediately perform Tawaaf-e-Widaa after performing Tawaaf-e-Ziyaarah and then her menses commenced before her departure to South Africa, no penalty will be applicable as a women in the state of menses in exempted from the performance of Tawaaf-e-Widaa.

However, if her menses terminated before her departure to South Africa, then it will be compulsory upon her to perform Tawaaf-e-Widaa before departing. In this case, she will not be exempted from performing Tawaaf-e-Widaa. Failure to do so will result in a penalty (Damm) being applicable. (Al-Mabsoot 4/179-Tabyeenul-Haqaaiq 2/51)
