Can I dispose of my friends mobile phone who uses it for Haraam purposes?

Q. If my friend is using his phone for Haraam purposes, can I take his phone away from him without his permission and dispose of it to prevent him from committing Haraam?

A. You cannot dispose of your friend’s phone, as you do not own it. If you dispose of it without your friend’s permission, you will be responsible for returning it to him. (Hidaayah)

Accordingly, you may advise your friend with wisdom and tact to abandon Haraam usage of his phone.
