Whose responsibility is it to financially provide for a divorced woman?


Q. My father divorced my mother and left her with no financial assistance whatsoever. Whose responsibility is it to financially provide for my mother now?

Is it the son’s responsibility only? Do the daughter’s also have a responsibility to provide for my mother? We are 6 children, 2 sons and 4 daughters.

A. In a marriage, a husband is primarily responsible to financially provide for his wife until a divorce (Talaaq) takes place and the wife’s waiting (Iddah) period terminates. Thereafter, the ex-husband has no financial responsibility towards his ex-wife.

In that case, the financial responsibility to provide for the ex-wife falls upon the children if they are capable of doing so. As such, the sons and daughters become equally responsible to financially provide for their mother once she is divorced/unmarried. (Shaami 3/623)
