A claim of reimbursement for renovations by an estate


Q. A lady passed away who had done renovations on a family members house. Can her estate claim back the value of those renovations as part of inheritance?

A. In the enquired case, if the deceased conducted any renovations on a property during her lifetime without any prior arrangement of payment or compensation for the same, the estate cannot make a claim to be reimbursed for the value of the renovations conducted on the property.

The estate may only rightfully make a claim to be reimbursed for the value of the renovations conducted on the property if there was prior arrangement of payment or compensation for the same which was not already paid.
