In many families, when a divorce takes place, especially, a divorce of a newly wedded couple, the parties demand the return of the gifts given after the Nikah. Is this acceptable?<\/strong><\/p>\n\n\n\n<p><strong>A. <\/strong>Any gift given and exchanged between the husband or wife or between the husband or wife\u2019s family after the Nikah belongs to the parties who have taken ownership of it.<\/p>\n\n\n\n<p>It is impermissible for any of the parties to demand the return of the gifted item\/s, whether after the Nikah or after a Divorce takes place. <strong>(Badaai\u2019 6\/128)<\/strong><\/p>\n\n\n\n<p>Rasoolullah Sallallahu Alayhi Wasallam said:<\/p>\n\n\n\n<p class=\"has-text-align-center\"><em>\u201cOne who takes back his gift (which he has already given) is like a dog that swallows its vomit.\u201d <\/em><strong><em>(Muslim)<\/em><\/strong><\/p>\n\n\n\n<p><strong>Allah Ta\u2019ala Knows Best<\/strong><\/p>\n\n\n\n<p><strong>Mufti Ismaeel Bassa<\/strong><\/p>\n\n\n\n<p><strong>themufti.com<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Demanding the return of gifts after a divorce Q.
